The government has recently published its much-anticipated Independent Sentencing Review, led by the former Lord Chancellor, David Gauke.  <\/p>\n\n\n\n

The Review\u2019s principal task has been to solve the current overcrowding crisis in prisons. Its key recommendations are estimated to reduce the prison population by around 9,800. <\/p>\n\n\n\n

Four of the nine recommendations are listed below:  <\/p>\n\n\n\n

    \n
  1. Revisit the statutory purposes of sentencing<\/strong>\u00a0– recommends amending the statutory purposes of sentencing to emphasise the importance of protecting victims and reducing crime.\u00a0<\/li>\n<\/ol>\n\n\n\n
      \n
    1. Strengthen alternatives to custody in the community – <\/strong>recommends revising the sentencing framework to ensure sentencers can take full advantage of the flexibility of community sentencing, including financial penalties and ancillary orders.\u00a0<\/li>\n<\/ol>\n\n\n\n
        \n
      1. Reduce reliance on custody – <\/strong>the expected recommendation to legislate to ensure short custodial sentences are only used in exceptional circumstances.\u00a0\u00a0<\/li>\n<\/ol>\n\n\n\n
          \n
        1. Incentivise progression from custody to community<\/strong>\u00a0– prisoners can be released earlier through \u201cearned progression\u201d, defined as rewarding compliance with prison rules.\u00a0<\/li>\n<\/ol>\n\n\n\n

          The review identifies two primary risks to effectively implementing the recommendations: <\/p>\n\n\n\n

            \n
          1. The probation system is left unable to cope with the additional demands.\u00a0<\/li>\n<\/ol>\n\n\n\n
              \n
            1. Politicians fail to resist the trend of introducing more and longer sentences for every crime.\u00a0<\/li>\n<\/ol>\n\n\n\n
