{"id":2578,"date":"2017-01-27T16:06:45","date_gmt":"2017-01-27T16:06:45","guid":{"rendered":"http:\/\/www.prisonersadvice.org.uk\/?p=2578"},"modified":"2017-01-27T16:06:45","modified_gmt":"2017-01-27T16:06:45","slug":"pas-howard-leagues-legal-aid-challenge-press-release","status":"publish","type":"post","link":"https:\/\/prisonersadvice.org.uk\/wordpress\/2017\/01\/27\/pas-howard-leagues-legal-aid-challenge-press-release\/","title":{"rendered":"PAS &#038; Howard League&#8217;s Legal Aid Challenge &#8211; Press Release"},"content":{"rendered":"<div>\n<p>Please find below the latest press release on our JR. \u00a0You can still help fund our legal battle through our <a href=\"https:\/\/www.crowdjustice.org\/case\/prisoners\/\" target=\"_blank\">Crowdfunding Campaign<\/a>.<\/p>\n<p>Friday 27 January 2017<\/p>\n<\/div>\n<p><strong>OPERATIONAL NOTE<\/strong><\/p>\n<p><strong>Court of Appeal to hear charities\u2019 challenge to legal aid cuts for prisoners<\/strong><\/p>\n<p><strong>Case:<\/strong> R (Howard League for Penal Reform and Prisoners\u2019 Advice Service) v Lord Chancellor<\/p>\n<p><strong>Where:<\/strong> Court of Appeal, London<\/p>\n<p><strong>When:<\/strong> 2pm on Tuesday 31 January<\/p>\n<p>Cuts to legal aid for prisoners are unfair and unlawful, and have coincided with a deterioration in safety in prisons across England and Wales, the Court of Appeal will hear in the course of a two day hearing next week (Tuesday 31 January).<\/p>\n<p>In July 2015, the two charities \u2013 the Howard League for Penal Reform and the Prisoners\u2019 Advice Service (PAS) \u2013 won the right to challenge the government\u2019s decision to cut legal aid for prisoners, including children. \u00a0Next week, three Court of Appeal judges will finally hear the charities\u2019 full arguments challenging the cuts.<\/p>\n<p>Since the cuts came into force in December 2013, violence and self-injury in prisons have risen to record levels. Almost 300 people have lost their lives through suicide.<\/p>\n<p>More prisoners than ever before have called the Howard League and PAS to seek help. Calls to charities\u2019 advice lines have increased by almost 50 per cent since the cuts were imposed.<\/p>\n<p>The impact of the policy has been far-reaching:<\/p>\n<ul>\n<li>It means that a prisoner who is being considered for transfer to an open prison, but not release, cannot get legal representation unless they pay<\/li>\n<\/ul>\n<ul>\n<li>It means that prisoners who are stuck in the system cannot get legal help to access the courses they need to become safe for release<\/li>\n<\/ul>\n<p>The claimants\u2019 skeleton argument in the case contends that: \u201cWithin the prison population are some of the most vulnerable members of society. There is a huge over-representation of the mentally unwell, those suffering from learning or other disability and the illiterate.<\/p>\n<p>\u201cFor a proportion of those prisoners the removal of legal aid makes it impossible for them to engage fairly in decision making processes that will have a huge impact on their lives, rendering those decision making processes inherently unfair.\u201d<\/p>\n<p><strong>Frances Crook, Chief Executive of the Howard League for Penal Reform, said:<\/strong> \u201cAt a time when prisons are out of control, access to justice is more important than ever.<\/p>\n<p>\u201cA system that is so inflexible as to deny a child or mentally ill person who is struggling to progress through the convoluted prison system the option of asking for funded representation is unjust and must be challenged.\u201d<\/p>\n<p><strong>Deborah Russo, Joint Managing Solicitor of the Prisoners\u2019 Advice Service, said:<\/strong> \u201cWe are finally before the Court of Appeal on this important case and sincerely hope the Court will be able to see the plight of prisoners and how these swingeing cuts have so severely curtailed their ability to access justice.\u201d<\/p>\n<p><strong>Notes to editors<\/strong><\/p>\n<ol>\n<li>The Howard League for Penal Reform is the oldest penal reform charity in the world.
